The European Energy Efficiency Directive of September 2023 has just been transposed into French law via the DDADUE Act. This change shifts the logic of how obligations are applied: company size is no longer the deciding factor ; energy consumption levels now determine the requirements. Companies that previously thought they were exempt may now fall under these obligations, even without any change in size or activity.
What changes with the DDADUE Act ?
The new legislation introduces energy consumption thresholds that determine the level of obligation for each organization. Depending on your situation, these thresholds may trigger a requirement to conduct an energy audit or go further by implementing an Energy Management System (EMS). This shift in logic also interacts with several existing requirements, including the IED directive and Best Available Techniques (BAT), the Tertiary Decree, and the BACS Decree, all of which must be considered together rather than in isolation.
