Whether an organization is certified or not, HSE regulatory monitoring can be integrated as a standalone process.
Its objective is to identify applicable texts, evaluate them in relation to the company, and monitor compliance.
Integrating HSE regulatory monitoring is essential, as it ensures compliance with the normative requirements of ISO 14001 (2015 version, 6.1.3 - compliance obligations) and ISO 45001 (6.1.3 - Determination of legal and other requirements). Above all, monitoring ensures prevention by limiting the potential risk of non-conformities (accidents, government inspections, loss of productivity, etc.).

The first step in setting up a regulatory monitoring process is to establish a list of applicable texts.
The goal of this action is to build a documentary database consisting of the texts and regulations associated with the company's or organization's activities.
However, identifying the texts is not enough. The organization must identify the specific requirements that apply to its operations.
In this sense, a single text may contain several requirements that are applicable to the company to varying degrees. Regulatory monitoring should focus only on the applicable requirements.
For every requirement applicable to the organization, a compliance assessment must be performed and updated whenever those requirements change.
In the event of non-compliance, the company must issue a declaration in accordance with its internal procedures.

After analyzing reported non-conformities, the organization must implement the associated actions (preventive, curative, corrective, or improvement-based).
These actions must be tracked in an action plan, with their effectiveness verified.
Organizational changes, the creation of a new business activity, or regulatory updates can impact applicable requirements and, consequently, an organization's compliance.
It is therefore necessary to implement a "dynamic" regulatory monitoring process to readjust the associated action plans. Compliance audits can be scheduled to verify that the list of applicable requirements remains up to date, that no non-conformities exist, and that the action plan is being executed and verified.
